Age Verification Policy

Urban Smoke TX is committed to preventing underage access to vaping products. You must be 21 years of age or older to purchase any product from our website. We strictly enforce this policy in full compliance with federal law.

Federal Law — Tobacco 21

On December 20, 2019, the federal minimum age for sale of tobacco products — including e-cigarettes, vaping devices, e-liquids, and all electronic nicotine delivery systems (ENDS) — was raised from 18 to 21 years nationwide. This law applies to all states, including Texas, with no exceptions. Urban Smoke TX fully complies with this federal mandate.

Texas State Law

Under Texas Health and Safety Code § 161.252, it is illegal to sell, give, or cause to be sold an e-cigarette to any person under 21 years of age. Violations can result in criminal penalties for retailers, including fines and license suspension. Urban Smoke TX operates in full compliance with Texas state vaping laws.

Our Age Verification Process

We use a multi-layer age verification system to ensure every customer is 21 or older:

1. Checkout Affirmation Before completing any purchase, you must check a box confirming that you are at least 21 years old and that the information you have provided is accurate. This is a legally binding affirmation.

2. Third-Party Age Verification We partner with industry-leading age verification services that cross-reference your name, address, and date of birth against authoritative public records, credit databases, and government data sources. This process is instant for most customers and does not affect your credit score.

3. Manual ID Review If our automated system cannot verify your age, we will place your order on hold and request a copy of a valid, government-issued photo ID. We will not ship your order until we have successfully verified your age. You have 72 hours to provide acceptable documentation.

4. Adult Signature Required at Delivery All orders containing vaping products require an adult signature (21+) upon delivery. Our shipping carriers will not leave packages unattended. You must present a valid photo ID to the delivery driver. If no one 21 or older is available to sign, the package will be returned to us.

Accepted Forms of Identification

We accept the following unexpired, government-issued photo IDs:

United States state-issued driver’s license
United States passport or passport card
United States military ID (active duty, reserve, veteran, or dependent)
State-issued identification card
Permanent Resident Card (Green Card)
Tribal identification card

We do NOT accept:

School IDs
Workplace IDs
Expired IDs of any kind
Photocopies or digital reproductions (unless specifically requested by our team for manual review)

Failed Age Verification

If we are unable to verify your age through any method and you do not provide valid identification within 72 hours, your order will be cancelled and a full refund will be issued to your original payment method. We reserve the right to refuse service, cancel orders, and ban accounts that attempt to circumvent our age verification system.

False Representation

Intentionally providing false age information to purchase vaping products is a violation of federal law. We cooperate fully with law enforcement agencies and will report fraudulent activity, including the use of stolen identities or fake IDs, to the appropriate authorities.

Parental / Guardian Purchases

We do not permit adults to purchase products on behalf of minors. If we suspect a purchase is intended for an underage person, we reserve the right to cancel the order and refund the payment.

Retail Store Age Verification

For customers visiting our Texas retail location, we operate a strict “Challenge 30” policy. If you appear to be under 30 years of age, our staff will request valid photo ID before completing any sale. No exceptions.
